Filming & Photo shoots

The Local Government Filming Protocol has been finalised by the NSW Government and came into force 30 March 2009.

Following the passing of the State Government Filming Related Legislation Amendment Bill 2008, Councils are now required to consider all filming applications favourably.

The impact of the legislation on Councils depends on the content of a new Local Government Filming Protocol provided for under the legislation,developed by State Government. The Protocol was released on 23 March 2009 and came into effect on 30 March 2009.

The key points of the Protocol are:

  • Councils are bound by law to use it for assessing applications by film-makers.
  • Alternative protocols can be approved by the Department of Local Government.
  • The act of filming itself, does not require approval.
  • There is a presumption in favour of quick approval for activities associated with filming.
  • Councils can apply conditions upon film-makers.
  • There is no application assessment timeframe.
  • If applicants are denied, reasons must be given in writing within three days of advice of denial.
  • Councils can charge a range of non-refundable application fees up to $500, depending upon the size of the production.
  • All other charges to film-makers can be determined by Councils, but must be set on a cost-recovery basis.
  • Councils are required to nominate a staff member as a designated Film Contact Officer.
  • A code of conduct for film-makers is included.
