Draft LEP 2011

Draft  Leichhardt Local Environmental Plan 2011

Council is preparing a new comprehensive Local Environmental Plan to replace Leichhardt Local Environmental Plan 2000. Local Environmental Plans (LEPs) are one of the primary planning tools to shape the future of communities. Through zoning and development controls, they allow councils and other consent authorities to manage the ways in which land is used. 

The draft Leichhardt Local Environmental Plan 2011 comprises of two parts: Written Instrument and Maps.

 

Why is Council preparing a new LEP?

In 2006, the NSW Government released an LEP template and all NSW councils are changing their LEP to meet this template. For the first time all LEPs in NSW will use the same planning language. The intent is to make it easier for communities to understand what is proposed for their local area. As a result, Council is required to prepare a new LEP that is consistent with the LEP template.
 

How is Council preparing the new LEP?

Leichhardt Council is currently working through the process of ‘translating’ Council’s current LEP to one that fits the template - the Draft Local Environmental Plan 2011 (Draft LEP 2011). Wherever possible, existing zones, provisions and controls are being matched with an equivalent provision under the Template. There are some cases where Council’s Draft LEP 2011 differs from what the Template requires, and these are carefully considered decisions.

 

Where are we now?

Council has forwarded a copy of the Draft LEP 2011 to the Department of Planning and Infrastructure to get approval to obtain a Section 65 certificate. The Draft LEP is not a Draft Local Environmental Plan for the purpose of Section 79C of the Environmental Planning and Assessment Act 1979 and is not a relevant consideration in the assessment of Development Applications by Leichhardt Council until it is formally exhibited.
